Terms of purchase
Before shopping at our online store, please read and agree to the terms and conditions of purchase of goods offered by the online store www.ledlietas.lv below.
1. Order
When making a purchase in the online store www.ledlietas.lv, the Buyer concludes a distance purchase and sale agreement with the Seller. The contract of purchase and sale shall be deemed concluded at the moment when the Buyer has selected the item in the catalog, executed the shopping cart, confirmed his / her acceptance of these Terms and Conditions and pressed the "Confirm Order!" Button.
1.1. In the product catalog, select the product you wish to purchase.
1.2. Once the product is selected, it should be added to the shopping cart - click the "Add to Cart" button to the right of the item description. Multiple prices may be added to the product description because the product is in more than one supplier's warehouse. Please note that when ordering goods from different warehouses, delivery times may vary. The delivery time for the item in question to the office is indicated by the hourglass icon in the item description. When done, the item is placed in the shopping cart, as evidenced by the change in the quantity of items in the shopping cart pictogram in the top right corner of the website.
1.4. In the "Shopping Cart" section you can see the picture of the item added to the cart, if any, in the system, its name, part number, availability, quantity and price. It is possible to change the quantity of a particular item in the order by clicking the +/- button. You can also delete an item in the shopping cart by clicking the trash can icon. To order spare parts, click the "Continue order" button. To order items, you need to create your own profile, if you already have your own profile, click on the "Login" button. Establishing a profile is necessary in order to be able to properly execute the formalities related to ordering the product, as well as to deliver the product to the exact address indicated by the customer.
1.5. After placing the order, a letter will be sent to your registered e-mail address with information about the goods you have ordered. If your order is selected for bank transfer, a prepayment invoice will also be sent to your email address. You will be notified by email of further order fulfillment.
1.6. You will receive an acknowledgment of receipt of payment and further processing of your order once we have received your prepayment for the goods ordered. Your ordered items will be shipped with the specified shipping method either to the specified shipping address or to the parcel machine within 1-2 business days.
2. Execution procedure
2.1 The total order execution time is counted in business days and is the longest time limit for delivery of any item included in the Order. Delivery times stated on the web site www.ledlietas.lv are valid if the Product is in stock at the spare parts manufacturer's warehouse at the moment of placing the Order. The indicated delivery time indicates the delivery time to the Seller's store in Riga. If the order is placed by parcel delivery or to a specific address, the delivery time may be longer.
2.2. By placing the Order, the Buyer confirms the purchase conditions for each item of the Product (delivery term, price).
2.3 The Order shall be deemed to have been fulfilled at the time the Goods are actually delivered to the Buyer. An integral part of the order receipt acknowledgment is the invoice issued by the Seller and signed by the Buyer or its authorized representative. In the event that the Buyer or its authorized representative is not at the above delivery address at the time of delivery specified in the Order, the Product will be returned to the Seller's warehouse and re-delivery must be paid by the Buyer in accordance with the terms.
2.4 After the fulfillment of the Order, the Seller's obligations to the Buyer shall be deemed fulfilled. In the event that the Seller has made two re-delivery Orders to the Buyer's designated address within the time specified above and the Buyer or its authorized representative has not been present at the specified address and time, the Seller's obligations shall be deemed fulfilled. The Seller has the right to refuse further delivery options and it is the Buyer's responsibility to arrive at the Seller's office and receive the Product.
2.5 Ownership and liability of the Goods shall pass from the Seller to the Buyer at the time of delivery of the Goods.
3. Right of withdrawal and procedure
The customer has the right to cancel the order before the customer has received this product, provided that the e-shop www.ledlietas.lv is reimbursed expenses, if any, incurred during the order execution. These would be transport costs, which are specific to each product / set of goods and depend on the size and weight of the product packaging.
The Buyer shall have the right to cancel the Order prior to the receipt of the Goods, provided that the Seller is reimbursed for expenses, if any, incurred in performing the Order.
3.1. Exercise of the right of withdrawal:
3.1.1 Upon receipt of the purchased Product, the Buyer shall have the right to exercise the right of withdrawal within 14 (fourteen) calendar days of receipt of the Product and return the Product without specifying the reason for returning it by filling out the cancellation form and returning the Item to the Seller's office. If more than 14 calendar days have passed since the receipt of the Goods, the right of withdrawal and the conditions of returning the Goods must be agreed with UAB devintas muziejus by calling the website number indicated on the website or by writing to info@ledlietas.lv.
3.1.2. By exercising the right of withdrawal and requesting the return of the Product, the Buyer shall return the Product to the Seller within 14 (fourteen) calendar days of receipt of the Product. After this time, the Seller has the right to refuse to take back the Product.
3.1.3. In the event of exercise of the right of withdrawal, the Buyer shall bear all costs related to the return / return of the Product to the Manufacturer, if the Product is ordered from the manufacturer's warehouse specifically for the Buyer.
3.1.4. Exercise of the right of withdrawal applies only to Natural Persons.
4. Rights and Obligations
4.1.1. Do not initiate the order execution if the specified advance payment for the Buyer ordered product has not been received.
4.1.2. If the Buyer has not paid the full amount of the order at the time of delivery, cancel the order. The exception is only if the Buyer and the Seller have agreed otherwise.
4.1.3. Unilaterally terminate the contract and sell the product to third parties if the goods are not requested by the Buyer within 7 calendar days from the date of the Buyer's notification of the arrival of the goods at the Seller's office. In this case, the buyer can only receive the pre-paid amount paid for the product after the product has been sold to third parties.
4.1.4. Refuse the order at any time if for any reason beyond the Seller's control the order proves to be impossible or is materially disrupted. The Seller shall immediately notify the Buyer of the cancellation of the order by e-mail or telephone. Upon the Buyer's request, the Seller undertakes to justify the refusal of the order in writing. In the event of a refusal to execute the order, the Seller undertakes to refund the amount paid to the Buyer within 5 working days.
4.1.5. Limit or suspend without prior notice the right to use the Internet Store www.ledlietas.lv and / or delete the Buyer's registration in the Internet Store if the Buyer attempts to disrupt the operation of the Internet Store or violates the terms of this Agreement. The Seller shall not be liable for any loss suffered by the Buyer as a result of the above actions.
4.1.6. In its sole discretion, restrict the sale of goods or terminate access to the Buyer through the Online Store, as well as restrict or terminate the ability to make a purchase to a Buyer who fails to fulfill its obligations when making purchases through the Online Store.
4.1.7. Claim against the Buyer in the manner prescribed by the laws and regulations of the Republic of Latvia if the Buyer unjustifiably refuses to accept the product and / or has misled the Seller.
4.1.8. The Seller also has other rights under these Terms and Conditions and the laws and regulations of the Republic of Latvia.
Rights and Obligations of the Seller
4.3.2. Purchase goods in the online store www.ledlietas.lv in accordance with these Terms of Contract and laws and regulations of the Republic of Latvia.
4.3.3. Request a refund if Seller is unable to comply with the terms of the contract.
4.3.4. Exercise the right of withdrawal.
4.3.5. To file a claim for loss of performance of an item during its lifetime in cases covered by the manufacturer's warranty.
4.3.6. . The Buyer also has other rights under these Terms, the Consumer Rights Protection Law and the laws and regulations of the Republic of Latvia.
4.4. Obligations of the Buyer
4.4.1. Familiarize yourself with these terms.
4.4.2. When placing an order, enter the exact item number according to the manufacturer's catalog. The Buyer assumes responsibility for the selection of the Product.
4.4.3. After the purchase and sale agreement has been concluded, pay for the goods according to the price indicated in the order, their delivery and accept the ordered goods within 3 working days from the day when the Buyer was informed about the arrival of the goods at the Seller's warehouse.
4.4.4. Upon receipt of the item, sign the documents confirming receipt of the item from the Seller.
4.4.5. Immediately correct your registration details in the online shop www.ledlietas.lv in case of changes in your personal data.
4.4.6. Do not transfer your login information to the Internet shop www.ledlietas.lv to third parties.
4.4.7. The Buyer shall also comply with other requirements set out in these Terms and the laws and regulations of the Republic of Latvia.
5. Price and order of payment
The total order price is the sum of the prices of all goods.
5.1. Prices are quoted in Euro. The seller is subject to VAT. VAT included.
5.2. The price of the product may differ from that indicated in the electronic catalog, if the order is made without using the electronic catalog of the online shop www.ledlietas.lv, but with the help of customer service specialists (by telephone or in the office).
5.3. The cost of delivery of goods is not included in the prices of goods in the online store www.ledlietas.lv. These costs are reflected in the completed order and the invoice issued to the Buyer.
5.4. Shipping costs will be determined individually for each order based on the shipping address, weight and size of the item ordered.
5.5. Seller reserves the right to make changes in the price list. If the Buyer has placed an order before the price change has taken effect, the price indicated on the Invoice at the time of order registration is valid for the item.
5.6. The Buyer shall pay for the Product in Euro currency on the basis of the Invoices issued by the Seller.
5.7. The Buyer shall pay for the goods and delivery by bank transfer in the form of prepayment, transferring them to the Seller's bank account indicated on the invoice and indicating the invoice number in the payment order. Upon receipt of the order, the Seller shall issue and send an Invoice to the Buyer at the specified e-mail address. Your order will begin processing after payment has been received in Seller's bank account.
5.8. Buyer pays within 5 business days. If the Buyer fails to pay the invoiced amount within the specified time, the Buyer shall be deemed to refuse to fulfill the terms of the contract and the Seller shall be entitled to suspend the order.
7.4. To obtain a warranty service, the Buyer must submit a claim request, accompanied by an official auto repair report of the lack of conformity. The complaint must include the name of the Buyer, the address of the Buyer, the date of ordering the item, the spare part number and the order number, as well as a precise description of the defect in the production of the item. If the defect is visual, photographs shall be attached which clearly show the defect found on the item. Complaint documents can be submitted either locally to the Seller's office or sent electronically to info@ledlietas.lv.
7.5. In order to receive the warranty service, the Buyer must keep and present the proof of purchase (delivery note), as well as deliver the goods to the Seller.
7.6. Claims received regarding the quality of the product will be settled in accordance with the norms of the Consumer Rights Protection Law of the Republic of Latvia (PTAL) and in accordance with the Cabinet of Ministers Regulations No.631. The procedure for filing and reviewing a consumer claim for a good or service that does not comply with the terms of the contract.
7.7. Seller is not responsible for:
7.7.1. for damage to the product caused by the negligence of the Buyer;
7.7.2. defects arising from the use of the goods for other purposes;
7.7.3. natural wear and tear of the product under normal use;
7.7.4. if the product is installed in a car service without the relevant equipment;
7.7.5. if the product is installed in a car service without the relevant license and certificate.
7.7.6. if the product was installed by a person who does not have the appropriate qualifications.
8. Liability of the Parties
8.1. The Seller shall be released from liability if the Buyer has placed an order without checking the conformity of the goods according to the data of the vehicle for which the goods are purchased.
8.2. The Buyer is responsible for all transactions made using his username and password in the online store www.ledlietas.lv.
8.3. It is the responsibility of the Buyer to provide the incorrect part number and, as a result, to receive the unnecessary part. In this case, the Seller shall be deemed to have fulfilled its obligations, and the Product may not be replaced or returned (except in the case of warranty).
8.4. The parties shall be liable for the violation of the contract of sale and sale in accordance with the legal acts of the Republic of Latvia.
8.5. The Seller shall not indemnify for non-pecuniary damage that the Buyer believes he or she may incur as a result of a change in delivery time or price, or due to other conditions, in accordance with these Terms.
8.6. The Parties shall not be liable for the total or partial non-fulfillment of their obligations under these Terms and Conditions by reason of force majeure such as: war or hostilities, fire, natural disasters, epidemics, explosions, acts or acts of public authorities, changes in customs legislation , import and export restrictions arising out of the will of the parties following the conclusion of the Agreement and other emergency situations, and where these circumstances directly affect the enforcement of the Terms.
9. Dispute Resolution Procedure
9.1 The Parties will make every effort to resolve their disputes and disagreements by negotiation. Unless the Parties have agreed by negotiation, all disputes shall be resolved in accordance with the legislation of the Republic of Latvia.
10. Closing Provisions
10.1 The Terms come into effect when the Buyer confirms their acceptance of all terms of the contract by clicking on the (consent mark) in the box provided before making the Purchase / Order payment. Unless the Buyer confirms their agreement to the terms of the contract, the Purchase / Order will not be executed.
10.2 In order to avoid any misunderstanding at the time of receipt of the Goods, the Buyer shall make sure that they are fully compatible with the selected Product - manufacturer, model, color, size and assembly.
10.3 To exercise the 14 (fourteen) day right of withdrawal, preserve and not damage the original packaging (if any) and packaging of the Product.
10.4 The Seller reserves the right to withhold or refuse to accept a Product that is defective, incomplete, or otherwise lost its original appearance or content.
10.5 Claims received regarding the quality of the Product will be processed in accordance with the laws and regulations of the Republic of Latvia.
10.6 It is recalled that the Consumer Rights Protection Act (PTAL) applies only to natural persons. Therefore, please note that legal persons cannot exercise the right of withdrawal
